General conditions of sale

Introduction

This site and the rights pertaining to it are owned in their entirety by Planète Collector (Planète Collector). The same rights apply to the corporate name, 'Planète Collector'. This website or any portion of this website may not be reproduced without our express consent. However, you may create hyperlinks to www.planetecollector.com without our express consent.

1. Acceptance of terms and conditions

By placing an order, the customer acknowledges that they are aware of the terms and conditions of sale detailed on this page and that they expressly accept them without reserve.

The current terms and conditions of sale govern the contractual relations between Planète Collector and its customer, the two parties accepting them without reserve. These general terms and conditions prevail over all other terms and conditions in any other document, except with prior, express and written dispensation.

2. Products

Photographs illustrating the products do not form part of the contract. In the event of errors, Planète Collector can in no event be held responsible. The majority of the products Planète Collector offers to its customers are available.

In no instance may the customer hold Planète Collector responsible for orders of products which are out of stock. The customer will either have to wait for the afore-mentioned stock to arrive or cancel their order.

3. Orders

The automatic recording system for orders is considered to be proof of the nature, content and date of the order. Planète Collector sends confirmation that the customer's order has been accepted to the e-mail address provided. The sale is not complete until the order has been confirmed. Planète Collector reserves the right to cancel the orders of any customer with whom they are in dispute regarding payment of previous orders. The information provided by the buyer when placing an order commits them to the following: in the case of an error in the delivery address, the vendor will not be held responsible for non-delivery of goods.

4. Livraison

Once the order has been confirmed, Planète Collector will deliver all the items ordered by the buyer to its carrier within 48 hours. The carrier will, in accordance with their contract with Planète Collector, deliver the order to the buyer's address supplied by Planète Collector.

In addition, for deliveries outside of mainland France, the customer will pay all the taxes liable for importing goods, customs rights, value added tax and any other taxes owed in accordance with the laws of the country of receipt. All orders placed with Planète Collector are intended for the customer's personal use; the customer or the recipient of the goods is forbidden to either partially or wholly sell on the goods. Planète Collector cannot be held legally responsible if the taxes have not been paid by the customer.

Orders for mainland France will either be sent via tracked and signed-for post or by FED EX, in accordance with the customer's selection. Delivery will be made within the agreed timeframe either directly to the named recipient or, in case of absence, to another person authorised by the customer. Delays do not entitle the buyer to claim compensation.

Orders for countries within the EU will either be sent via tracked and signed-for post or by FED EX, in accordance with the customer's selection. Deliveries outside of the EU will either be sent via the international postal services or by FED EX, in accordance with the customer's selection.

In the event of faulty or damaged goods, the buyer has the right to return them in accordance with the terms and conditions outlined in this document.

The following are considered to be instances of force majeure releasing the vendor from the obligation to deliver: war, rioting, fire, strikes, accidents and the impossibility of receiving stock. Merchandise always travels at the recipient's risk. Always check your goods upon delivery. You have 48 hours in which to submit a claim to the carrier in the event of non-delivery or damage.

Subject to availability, an order may be delivered to the customer in several instalments; the customer however will not be charged extra for postage. If the customer wants separate deliveries, they must place separate orders and pay the appropriate postage costs.

5. Delivery

Customers have seven days (from the date the item is received) to return the goods. Goods must be returned to Planète Collector in good condition and in their original packaging (unopened).

With regard to clothing, refunds or exchanges will be offered for manufacturing flaws and errors in size. Planète Collector will not offer refunds or exchanges for any damages that it deems to be attributable to the customer.

Rest assured, however, that we take great care to process your orders in accordance with our company charter.

In the event of goods being returned, Planète Collector will refund in full the amount paid by the customer, with the exception of the return costs. Refunds will be made within 15 days.

6. Price

The price is given in euros.

The price given in the product details does not include delivery costs.

The price given in the order confirmation is the final price, all taxes included as well as VAT for France and countries within the EU. This price includes the price of the goods and handling, packaging, storage and delivery costs.

7. Payment

The price billed to the customer is the price given on the order confirmation provided by Planète Collector.

The price of the goods is payable the day that the order is accepted.

Payment is made using a credit/debit card bearing the CB sign.

Webaffaires allows you to pay securely over the Internet via the Crédit du Nord's banking server.

Your credit/debit card number is routed to the bank's servers, where payment is made directly to the bank in a secure environment without going through the vendor's server. This guarantees that only our banking partner (Crédit du Nord) has access to your card details.

The order placed by the customer will not be considered to be accepted until the relevant banking payment centres have agreed. In the event of refusal by the afore-mentioned centres, the order will be automatically cancelled and the customer informed by e-mail. In addition, Planète Collector reserves the right to refuse any order from a customer with whom they are in dispute.

8. Legal disputes

This contract is subject to French law. Planète Collector cannot be held responsible for damages of any nature, whether to goods or persons, which may result from the malfunction or misuse of the goods sold. The same applies to any changes to goods made by the manufacturers. Planète Collector's responsibility will in any event only extend to the order value and it will not accept responsibility for trivial errors or omissions which may occur despite the effort made to faithfully represent the product in the product details. In the event of difficulties in enforcing this contract, the buyer has the possibility, prior to taking legal action, of seeking an amicable solution with the help of: a professional association active in the sector, a consumers association or any other advisor of their choice. Customers are reminded that seeking an amicable solution does not suspend the 'short period' of the legal guarantee or the duration of the contractual guarantee. Customers are reminded that, as a rule and subject to the judgement of the courts, the measures in this contract relating to the contractual guarantee shall not be respected if the buyer does not honour their financial commitments to the vendor.

We are proud to confirm that we pay close attention to any complaints received, good faith always being presumed on the part of those who take the trouble to bring such situations to our attention. In the case of dispute, the customer should first address themselves to the company to obtain an amicable solution.

In the absence of an amicable solution, the Lille Commercial Court is the only entity with any authority, irrespective of the delivery address or the payment method.

9. Guarantee

Planète Collector cannot be held responsible for not respecting the regulatory and legislative measures in force in the country of receipt. Planète Collector's responsibility is automatically limited to the value of the goods in question at the time of sale and there shall be no recourse against the brand or company which produced the product.

Whatever the circumstances, the customer has legal protection regarding sole ownership and against hidden defects (article 1625 onward of the French Civil Code). Provided that the buyer can demonstrate the hidden defect, the vendor is legally bound to rectify all the consequences (article 1641 onwards of the French Civil Code); if the buyer takes legal action, they must do so in the 'short period' starting from the discovery of the hidden defect (article 1648 of the French Civil Code). 10. Legal information

Personal information is an obligatory requirement for the purposes of distance selling, this information being indispensable for processing and transporting orders and for preparing bills and warranties. Insufficient information will result in the order being invalid.

In accordance with France's Data Protection Act (loi informatique et libertés), the processing of a customer's personal information is the subject of statement number 1064107 by the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés).

The customer has the right (article 34 of the Law of 6 January 1978) to access, modify, rectify and delete information pertaining to them; they can exercise this right by contacting Planète Collector (planetecollector@skynet.be). In addition, Planète Collector undertakes not to offer nor to sell its customer's details to a third party.
